April 20, 2008 MAJOR FAIR HOUSING CASE AGAINST OMG CLIENT DISMISSED IN FEDERAL COURT Judge William T. Moore for the United States District Court for the Southern District of Georgia granted the defendant's motion for summary judgment and dismissed plaintiff's claims of race discrimination under the Georgia and Federal Fair Housing Act, Fourteenth Amendment, Thirteenth Amendment, and Georgia Constitution in their entirety. | April 16, 2008 DREW WILKES' ARTICLE ON TORT REFORM TO APPEAR IN THE JOURNAL OF THE GDLA Andrew M. Wilkes, a senior associate in the firm's litigation department, has authored a survery article that will appear in the 2008 Journal of the Georgia Defense Lawyers Association. The article is titled "Senate Bill 3: Three Years Later," and identifies case law and legislative developments that have arisen since the enactment of the tort reform legislation in February 2005.

Franklin, Jr., Leslie Pickett Sheehan, and Alison Sawyer on their victory at the Georgia Supreme Court in the case of Al-Jabi, et al. v. Canas, 2007 Ga. LEXIS 790. This case involved a question of critical importance to Georgia's physicians: in cases involving serial misdiagnoses of a patient's ailment, what are the time limitations within which a patient must commence a lawsuit? The plaintiff advocated an expansive view of the law in which the time to commence suit would have stretched on for many years. OMG's attorneys persuaded the Georgia Supreme Court to adopt a narrower approach (favorable to physicians) that has had the effect of minimizing the window of opportunity in which a plaintiff may file a lawsuit. | January 31, 2008 PAT O'CONNOR AND JIM GERARD SECURE VICTORY IN DECADE LONG LITIGATION The United States Court of Appeals for the Eleventh Circuit recently affirmed summary judgment in favor of the City of Garden City, Georgia in the City's long running dispute with CSX. CSX Transportation, Inc. v. City of Garden City, 2007 U.S. App. LEXIS 28793. Patrick T. O'Connor and James P. Gerard represented Garden City in this successful campaign that spanned 10 years, four appearances in the Federal Court of Appeals and two separate certified questions to the Georgia Supreme Court.
